1. Definitions:

Service – the website available at: www.atopigo.pl;
User – a person visiting the website www.atopigo.pl;
Owner of the website www.atopigo.pl – Chema-Elektromet Spółdzielnia Pracy based in Rzeszów (35-105), ul. Przemysłowa 5, entered into the Register of Entrepreneurs kept by the District Court in Rzeszów, 12th Commercial Division of the National Court Register under KRS number 0000092150, NIP: 813-02-67-639, REGON: 000141717; hereinafter referred to as “Chema” or the “Administrator”.

2. This Privacy Policy defines the rules for collecting, processing, and using data, including personal data, obtained through the Service by Chema-Elektromet Spółdzielnia Pracy, which is the Personal Data Administrator.

3. Personal data are processed by Chema in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).

4. Through the website, Chema may collect the following User data:

a. information about the User's use of the Service – such as the time, IP address, and manner of use;
b. technical information about the User’s devices used to access the Service;

5. Purposes and legal basis for processing User data:

a. Direct marketing of Chema's products and services – legal basis: Art. 6(1)(f) GDPR – legitimate interests;

c. Handling inquiries submitted by the User – legal basis: Art. 6(1)(f) GDPR;
d. Pursuing claims related to contracts – legal basis: Art. 6(1)(f) GDPR;

6. Providing personal data is voluntary, but necessary for handling inquiries or complaints. In contractual relationships, data provision is required for contract conclusion and execution. Data may be processed and stored if Chema has a legitimate interest that overrides the User’s interests and fundamental rights. If not, data may still be stored if legally required, solely for compliance purposes.

Personal data may be shared with entities processing data on behalf of the Administrator, such as IT service providers, data storage or removal providers, or accounting and debt collection companies – based on agreements and under the Administrator’s instructions. Data will not be transferred outside the EEA without explicit consent. Data may be disclosed upon request to public authorities such as courts, prosecutors, police, or supervisory authorities.

8. Personal data will be stored for the duration of the business relationship. Afterwards, data will be anonymized. For legal claims or complaints, data will be kept in limited scope for up to 5 years. Chema will cease data processing for marketing purposes if the User objects.

9. The User has the right to access, correct, delete, or restrict processing of their data. The User may request to receive their data in a structured, commonly used format and transmit it to another administrator. If the basis for processing is legitimate interest, the User has the right to object, especially to direct marketing. The User may also file a complaint with a data protection authority. 10. By using the Service, the User agrees to receive marketing materials as an integral part of the website. These include, for example, banners used by Chema to promote products and services or other advertising content.

11. Matters not covered by this Privacy Policy are governed by relevant legal provisions.

12. The Data Administrator reserves the right to amend this Privacy Policy by publishing a new version on the website.
